Foundation jurisdictions
Despite the popularity of foundations for succession planning and asset protection, there are relatively few jurisdictions where they can be established.In Europe, it is the German speaking countries where foundations can be established. The best known of these jurisdictions is Leichtenstein, favoured by the wealthy aristocracies of Europe.
The other jurisdictions with laws permitting the setting up of foundations are found in and around Central America.
Probably the best known of these is Panama.
Panamanian foundation law follows Leichtenstein foundation law very closely.
Lawyers are required to set up foundations, providing an additional level of confidentiality above and beyond the confidentiality provided under foundation laws.
It is far simpler and more affordable to set up foundations in Panama and her neighbouring countries.
Panama is also a major international banking centre but unlike Leichtenstein and the other European foundation jurisdictions, is not a signatory to the EU Savings Tax Directive.
